This book examines the evolution of climate law, focusing on the prospects for climate justice in a geopolitical era marked by multiple international tensions. Special attention is paid to the content and scope of the Interna tional Court of Justice’s Advisory Opinion on States’ obligations in relation to climate change. The article concludes by considering the role that climate justice can play in strengthening public participation and accountability in climate governance.
Taking European climate litigation as its point of departure, this essay examines whether “climate rights” can properly be said to exist. The individual actions brought against the European Union and its Member States provide fertile ground for investigating the noumenon of the legal positions associated with climate stability.
Il testo esamina l’evoluzione del diritto climatico, soffermandosi sulle prospettive della giustizia climatica in una fase geopolitica segnata da molteplici tensioni internazionali. Un focus particolare è dedicato al contenuto e alla portata del parere consultivo della Corte Internazionale di Giustizia sulle obbligazioni degli Stati in materia climatica.
